The ninth circuit court has upheld a ban on deploying national guard in the Oregon city, following a recent legal decision.

Appeals Court Agrees to Rehear Case

The federal appeals court decided on Tuesday that it would rehear the legal dispute concerning the executive power with an expanded panel of eleven justices. The court also vacated a previous ruling from a three-judge panel that had supported the administration.

Ongoing Dispute Over Military Presence

This order represents the most recent turn in a protracted legal battle over whether the administration has the authority and valid reason to deploy state military units in the city. Approximately two hundred troops have been in limbo since late September when the mobilization attempt was initiated in response to months of protests.

Conflicting Arguments

The administration has claimed that federal officials at the immigration center in south Portland were under attack, while local authorities maintain that municipal police have control of the circumstances.

Contrary to descriptions of Portland as “war ravaged”, residents have been sharing videos of scenic paths and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The Tuesday ruling came after a US district judge in the city issued two legal injunctions this month – one blocking the federal control of the Oregon national guard, and another stopping the deployment of any national guard troops in the state, after efforts to circumvent the first order by mobilizing troops from California.

On the previous day, the ninth circuit panel had put the first ruling on hold – permitting command of 200 Oregon national guard – but the second ruling remained in place, blocking the physical sending of the forces.

En Banc Review

The Tuesday decision means the matter will be heard by the full court – with all decisions under consideration simultaneously – by a panel of eleven justices.

“This ruling shows that the truth matters and that the judicial system are working to ensure government responsibility. The founding document restricts the executive authority, and local populations cannot be treated as a training ground for expansive government power,” said the state attorney general in a official comment.

“The judicial body is sending a clear message: the president cannot dispatch the military into US cities without cause. We will continue defending state legislation, principles, and autonomy as this case moves forward and our fight continues in the courts.”
